California employers must pay the minimum wage without factoring in employee gratuities or tips. Tips cannot be credited against the minimum wage. And California employers are prohibited from taking any portion of tips or deducting the amount of tips received from salary due. Similarly, supervisory employees with a certain level of authority are prohibited from participating in any tip pool from which they receive a portion of the tips earned by lower level employees.
